Can hybrid vehicles switch to EV mode to cheat at emissions testing?

Typically you'd imagine that hybrid vehicles are tested for emissions with a charge sustaining strategy with intermittent engine use. Why wouldn't they decide to switch to a charge depleting strategy in EV mode to p emission testing such as EURO V etc.
